Andrew Spangler concentrates his practice in regulatory matters and complex commercial litigation, including telecommunications, medical device product liability defense, construction and mechanics liens, government contracting, employee restrictive covenants, insurance coverage and subrogation, and complex contract disputes. Mr. Spangler also has extensive experience in municipal and education law. He has represented clients in trials, appeals and regulatory appeals in state and federal courts throughout the United States.
In the area of regulatory law, Mr. Spangler has represented a national telephone service provider in business tort and contract litigation across the nation, including: (1) a tortious interference case in federal court for the Southern District of Florida, handling both the initial motion to dismiss and arguing the appeal from the order dismissing the claims; and (2) a Lanham Act false advertising case in the Northern District of Illinois. Mr. Spangler has also represented a telecommunications provider in regulatory appeals from rulings of state public utilities commissions under the Telecommunications Act of 1996, including preparation of appellate briefs filed in the Sixth, Ninth and Tenth Circuit Courts of Appeals, as well as regulatory appeal briefs submitted in the United States District Courts for the Northern District of Illinois, the District of Arizona, the Eastern District of Michigan, and the Western District of Michigan.
Mr. Spangler practiced with the law firm of Jenner & Block, LLP from 1992 through 2001, where he was admitted to the partnership in 2000. Mr. Spangler served as Senior Assistant General Counsel for Commercial Litigation for the Chicago Board of Education from 2001 through 2004, where he defended the Board in high profile commercial cases, including a $5 million breach of contract claim regarding medical claims auditing. Mr. Spangler also counseled the Board regarding the interpretation and implementation of the No Child Left Behind Act of 2001. Mr. Spangler was a partner in the law firm of Dahm & Elvin, LLP from 2004 through 2006.
Representative Transactions:
- Represented manufacturer in $5 million claim for breach of an exclusive distribution contract governed by Brazilian law.
- Represented government vendor in $20 million dollar claim against the State of North Carolina challenging the constitutionality of a charge levied on vendors for the mandated use of a web-based bidding system.
- Represented bidder in dispute with government agency regarding award of $52 million contract.
- Represented manufacturer of medical devices in the defense of product liability cases throughout the United States.
- Represented national telecommunications carrier in regulatory appeals arising under the Telecommunications Act of 1996.
- Represented inventor of battery charging device used in uninterruptible power supplies in patent infringement jury trial.
