LAND USE AND REAL ESTATE

                     

  • Presently representing numerous real estate developers in establishing TIF districts and executing redevelopment agreements for what amounts to nearly $200 million in TIF assistance. These projects include thousands of homes, commercial space and charter schools.
  • Represented one of the nation's largest Spanish language radio companies in the development of its antennae facility.
  • Represented one of the nation's largest industrial REITs in developing successful legislation that would provide incentives for development of large scale intermodal rail hubs in Illinois.
  • Represented a national bank in obtaining special use approval for bank facilities in different locations in the City of Chicago.
  • Represented one of the nation's largest utility companies in lease negotiations and obtaining zoning and building approval for the development of a new 30-acre center in the Southwest suburbs.
  • Represented a major entertainment company in pursuing a special use permit for operations in the Northwest suburbs.
  • Represented a major national auto parts chain in complex real estate litigation involving tortious interference with contractual easement rights. 
  • Defended federal condemnation action authorized by Order of the Federal Energy Regulatory Commission.

CONSTRUCTION LAW

                      

  • Represented several of the Midwest's largest contractors in transactions, procurement, contract matters, claim negotiations and settlements, and litigation.
  • Represented general contractor in obtaining approximately $2,000,000 in payments withheld by owner of construction project after owner had alleged that portions of the construction were defective.
  • Successful, non-litigated resolution regarding allegations of our client not meeting contract specifications of concrete walls.
  • Represented clients in disputes with public agencies regarding delays and changes in scope of work on public construction projects.
  • Assisted client in disputes with a state university alleging construction defects caused damage to dormitory building.

PROCUREMENT

                 

  • Counseled client in preparing bid and oral presentations to procuring agency to successfully win $20,000,000 concession agreement.
  • Represented client regarding dispute with procuring agency about MBE/WBE participation submitted in bid documents; after extensive negotiations and written advocacy, the procuring agency's questions were resolved in favor of the client and the client was awarded a $50,000,000 contract.
  • Counseled client in preparing and presenting response to repeatedly win service delivery agreement with major public agency.
  • Represented client in protest regarding winning bidder's failure to comply with specifications set forth in bid documents regarding products to be supplied to a major public facility.
  • Counseled client about validity of potential challenges to bids awarded to competitors, including analysis of legality of evaluation criteria.

REGULATED INDUSTRIES

                    

  • Representation of Illinois utilities in contested rulemaking proceedings before the ICC and the Illinois Circuit Court, including representing various utilities regarding proposals for increased rates.
  • Representation of a national telephone service provider in regulatory appeals made rulings by state public utilities commissions regarding interconnection agreements under the Telecommunications Act of 1996, including advocating the utility's position regarding the operation of telecommunications networks and the interconnection between incumbent carriers and new carriers attempting to en ter local telecommunication markets.
  • Successfully prosecuted a constitutional challenge to application of an Illinois administrative regulation, including appeals to the Illinois Supreme Court.
  • Obtaining dismissal of consumer fraud class-action claims brought against a utility based upon practices relating to charges and deposits.

EDUCATION LAW

                     

  • Represented a major developer in the site control, entitlement, financing and permitting of $50 million in new charter schools.
  • Represented various alternative education providers regarding various issues related to licensure and operations.
  • Representing Illinois school district in all aspects of its operations, including educational, contractual and financial issues.

LITIGATION

                 

  • Represented private money lender in commercial mortgage foreclosure and related matters arising out of defaults under mortgages obtained to finance condominium conversion project.
  • Represented investor in fraud and breach of contract action arising out of real estate joint venture formed to develop large office condominium project.
  • Represented public agency in jury trial resulting in verdict in agency's favor arising out of collision involving truck that was carrying an illegal load.
  • Represented manufacturer of pumping equipment in trade secret action against former employee who was soliciting sales for competitor in the same territory for which employee had been responsible during his employment with manufacturer.
  • Represented an international air freight warehouse facilities company vindicating its rights against a former employee, including accusations of defalcation and violations of the Federal Computer Fraud and Abuse Act.
  • Directed all civil litigation outside of Illinois for a national retail department store chain headquartered in Chicago.
  • Represented a major asset, investment and pension fund management company and its real estate investment trusts in various civil disputes throughout the United States, protecting the integrity of its assets under trust.
